Third-party issues: We are not responsible for issues caused by third-party services, plugins, hosting changes made by the client, or modifications to code made outside of our team.

HIPAA-compliant hosting is subject to additional terms and pricing. A signed BAA is required before any protected health information (PHI) is stored or processed on our systems.
To the maximum extent permitted by law, Pragmatic Business Solutions, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from or related to the use of our services.
Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim in the 12 months preceding the event.
All deliverables are provided "as-is" upon delivery. We warrant that our work will substantially conform to the agreed-upon specifications for a period of 30 days after delivery. Beyond this warranty period, all services are provided without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

Any disputes arising from these terms or our services shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached within 30 days, either party may pursue mediation or binding arbitration in Starr County, Texas.
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal action must be brought in the courts of Starr County, Texas.
We reserve the right to update these Terms of Service at any time. Changes will be posted on our website with an updated "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.

Once you opt out, you will no longer receive text messages from us unless you re-subscribe. Opting out of SMS does not cancel your services or affect your account in any way. You will continue to receive email communications.
Wireless carriers are not liable for delayed or undelivered messages. The following limitations apply:

Pragmatic Business Solutions offers in-house financing to help businesses invest in the technology they need without paying everything upfront. Our payment plan terms are as follows:
Missed or late payments may result in temporary suspension of hosting services and project deliverables until the account is brought current. The client retains full ownership of all code, designs, and deliverables upon completion of all payments as outlined in the project agreement.
